Terms Of Service
GENERALBy commissioning me, you agree to this Terms of Service. Upon approval of a commission request, both Artist and Client have agreed to these terms.
I will draw:
- Female/Feminine characters
- Flat-faced Anthro characters
- Pin-up and suggestive contentI will not draw:
- In another art style
- Offensive, obscene, or hateful content
- Graphic NSFW
- Excessive gore such as organs, dismemberment, etc (light blood such as cuts and blood splatter are okay)- If you are unsure if your request is within my abilities, please do not hesitate to reach out!
- This is a digital art commission, meaning no physical goods will be received or created.
- Any artwork created will be posted to my social media. If you wish for work to be kept private either temporarily or indefinitely, this will result in a fee and must be discussed before payment.
*Any artwork created MAY NOT be used in any way with relation to NFTS or AI. This includes minting, data scraping, machine learning, blockchain use, or any other such use.
- The client must have authority to enter this contract and is responsible for decisions and approval throughout the process.
- The character design, reference material, and other resources provided to the artist must legally belong to the client, and the artist is permitted to replicate such character design for the artwork.
- The work created by the artist will be original and the artist has permission to use copyright-free assets and/or tools to create the artwork.
- The artist reserves the right to refuse projects based on content, subject, and/or personal reasons.
- All aspects of the artwork will be discussed prior to beginning work, including the price, character(s), deliverables, and other details.PAYMENTS- Payment will either be made 1) in full before beginning the artwork or 2) for artwork over $100, payment can be split between 50% before beginning the artwork, and the final 50% once a sketch has been delivered and agreed upon
- Payment will be sent via paypal once the artist is ready to begin work, and money will not be accepted until the artwork can be started
- Upon accepting a request, payment must be sent within 72 hours. If payment is not sent within this time frame, the client’s slot will be forfeited.
- Prices may change depending on requirements or additional requests, and this will be agreed upon before sending the invoiceREVISIONS- During the sketching phase, revisions up to 3 are allowed
- Once lineart begins, revisions bring additional fees stated in the project details
- Any errors of the artist's will be fixed for free, such as forgetting details of a character
- Revisions may alter the progress and timeline of the artwork, and this must be taken into consideration
- Upon final delivery of the artwork, the client may not edit the artwork without approval from the artist (outside of cropping for social media, compressing the file, and different 'edits' that do not affect the visuals of the artwork)DEADLINES AND DELIVERY- The artist may take up to 3 months to complete the artwork, depending on the project. Deadlines will be treated on a case-by-case basis and will be agreed upon before payment. Projects will take no longer than 3 months unless specifically discussed and agreed upon.
- 3-month deadline (or other pre-discussed deadline) begins upon payment and does not include time spent waitlisted.
- Final artwork will be delivered via Google Drive in the format of a PNG. If any other file types are necessary, they will be provided on request. The only file that will not be accepted is the full PSD, for the protection of the artist. Compressed and/or merged PSDs may be requested.
- The google drive link will not be active forever, and folders will be deleted after a month. The client must download the files between this timeframe to their own devices.
-If there are any delays or adjustments to the timeline, the artist will notify the client immediately.
- If no artwork has been delivered after three months, and there is no agreed-upon timeline, the client is eligible for a refund.USE AND INTELLECTUAL PROPERTY RIGHTSArtist's Rights:
- By default, the artist retains copyright, ownership, redistribution, and intellectual property rights. This includes but is not limited to display, advertising, printing, etc the work on websites, social media, portfolios, and other such places.
- Rejected work-in-progress versions may be used in other projects at the artist's discretion, under the condition that it does not infringe on the client's intellectual property rights and ownership of their likeness, character, design, branding, or other such trademarks.
Client Rights for Personal Use Artworks:
- The client receives non-transferable usage rights to the work for personal use
- Personal use is as follows: display on social media accounts for promotional purposes with no direct monetization or sales, such as social media profile pictures, banners, and posts; printing and framing in personal spaces; display as part of a website or channel; any other instances where no monetization of the work is involved
- The client cannot claim the work as their own, and must credit the artist using their social media tag/username/link when displaying the artwork. This credit must be easy to find.
Client Rights for Commercial Use Artworks:
- Commercial use rights are not included in general commissions and must be specified in the project request. Commercial rights must be agreed upon by the artist and client and will cost an additional fee discussed before invoicing.
-Commercial rights are as follows: usage of the work in streams, videos, advertisements, and other monetized content; selling or reselling the artwork to another party as part of a product or merchandising, use by the client for brand identity such as character design and likeness are exclusively transferred to the clientREFUNDS- Full refunds can be provided up until a sketch is agreed upon
- Once a sketch is agreed upon, refunds will only be partial according to the amount of work completed
- If the artist cannot complete the work for any reason, the client may be eligible for a full refundCOMMUNICATION- Ongoing communication and discussion will occur throughout the project to keep both parties up to date. This includes work-in-progress pictures, idea generation and collaboration, situational updates, and more.
- Updates will be provided throughout stages of the art process, such as sketching, line art, base colors, and multiple pictures throughout rendering. Updates may also be provided upon request, but may not be requested in excess.
- Communication will take place via email or other communication methods provided on the request form. This includes but is not limited to Discord, Twitter, and Toyhou.se.
- The response time of the artist may vary, and responses may take up to a week to provide concrete updates.
- Both the artist and client agree to discuss relevant matters to the project. Both parties retain the right to decline other topics of discussion.
